U.S. Supreme Court Rules on IEEPA Tariffs – February 20, 2026
Based on today’s Supreme Court ruling, the Court held that the International Emergency Economic Powers Act (IEEPA) does not authorize the president to impose reciprocal and fentanyl-related tariffs.
CBP has not yet given guidance on how the ruling will affect entries currently on the way or not yet liquidated. It is also uncertain whether the administration will seek to reimpose tariffs through other statutory provisions.
Flegenheimer is waiting for formal CBP guidance before we can make any changes on entry filings. We are currently monitoring alerts from CBP and NCBFAA for further instructions.
