Tariffs Update on Brazil Imports – Section 301 Effective July 22

The Office of the U.S. Trade Representative (USTR) has issued a Federal Register notice  implementing a new 25% Section 301 tariff on imports from Brazil.

The additional 25% tariff will apply to imports from Brazil, with exceptions for certain products specifically identified in Annex I and Annex II of the notice.

This tariff will be effective with respect to goods entered or withdrawn from warehouse for consumption on or after 12:01 am EDT on July 22. 


A limited in-transit exception is available for goods that:

  • Were loaded onto a vessel at the port of loading and were already in transit on their final mode of transportation to the United States before 12:01 a.m. EDT on July 22, 2026; and
  • Are entered or withdrawn from warehouse for consumption before 12:01 a.m. EDT on July 29, 2026.

The product exclusions cover several tariff classifications, including certain agricultural, seafood, and other specified products. Importers should review the HTS numbers listed in Annex I and Annex II to determine whether their products qualify for an exclusion.

Potential Tariff Stacking

Importers should also be aware that this new 25% Section 301 tariff may be cumulative with Brazil’s proposed 12.5% Section 301 forced labor tariff,.

We anticipate that CBP will issue a CSMS message within the next few days providing implementation guidance, including the new Chapter 99 HTS numbers that must be reported on applicable entries.
